Assault
The vast majority of ‘Assaults’ or ‘Violent Crime’, is governed by the Offences Against the Person Act 1861.
Such offences include:
- Assault Occasioning Actual Bodily Harm (ABH s.47)
- Malicious Wounding or Grievous Bodily Harm (GBH s.20)
- Wounding and causing Grievous Bodily Harm with intent (GBH s.18)
Offences such as Common Assault, Assault PC, Assault on an Emergency Workers, are governed by alternative legislation.
Violent offences have a wide range of sentencing options, statutory maximums for the most commonly charged offences are as follows:
Offence | Maximum Sentence |
Common Assault | 6 Months Imprisonment |
Assault PC | 6 Months Imprisonment |
Assault on Emergency Worker | 12 Months Imprisonment |
ABH (s.47) | 5 Years Imprisonment |
GBH (s.20) | 5 Years Imprisonment |
GBH (s.18) | Life Imprisonment |
The issues in such offences however can be just as complex as other crimes, and further, what may be seen as a wholly innocuous incident by some, could still be deemed an assault, and may still attract criminal liability, regardless of whether there is any intention on behalf of an individual to assault the victim or otherwise.
