Dishonesty offences generally involve the ‘taking of an item’ that doesn’t belong to the individual taking it, however, this is not always the case.
Burglary
- Burglary for instance can be committed by just ‘entering a property or area of a property without permission with the intention of stealing an item, committing damage, or committing another offence such as GBH or Rape’.
- It is therefore not necessary for an item to actually be taken for the offence of Burglary to be made out.
- Another issue to be considered is whether the property in question was commercial or residential, as this will effect sentence, along with a whole host of other ‘aggravating’ features.
Theft
- Theft like Burglary, can take many forms, from shoplifting, to theft from an employer, to identify fraud. However, and like Burglary for instance, there are a number of different elements to the offence, and all of these 5 key elements must be satisfied, namely:
- • Dishonesty
- • Appropriation
- • Property
- • Property belonging to another
- The intention to permanently deprive the lawful owner of the property. If these elements are not satisfied there is a very real chance that the offence will be dropped and any defendant acquitted.
Robbery
- Robbery is an offence of violence as well as being one of dishonesty. Robbery is committed where a ‘theft’ takes place with the use of force, or where there is a threat of the use of force. For instance, an individual is stopped on the street, assaulted, and a wallet stolen, that would constitute Robbery.
- An Armed Robbery is as above, but where a weapon is used, such as a knife or a gun.
- Offences under the various Theft Acts are therefore not necessarily straightforward, and deserve the full attention of any advocate.
