Murder and Manslaughter
Offences of Murder and Manslaughter, despite being arguably the most serious of category of offences, do themselves vary in severity dependent on circumstances.
Further, the various elements and subcategory of offences are equally as serious and often, complex, such as:
- Attempted Murder
- Conspiracy to Commit Murder
- Joint Enterprise
- Voluntary Manslaughter
- Involuntary Manslaughter
For someone being investigated for such an offence, it is essential that specialist representation is secured immediately, particularly when an accused is potentially at risk of spending the rest of their lives in prison.
A whole host of questions will need to be answered by the Prosecution, and therefore the Jury prior to a verdict being returned.
Is there evidence of intention to kill? Did the accused cause the death? Did the accused contribute to that which brought about death? Or was it negligence? Was death foreseeable? Or is it accepted that the actions caused the death of the individual in question? But there was no intention for that to happen?
Just as the offences themselves are complex and of the utmost severity given that a conviction can result in a Life Sentence (in terms of Murder, that life sentence is mandatory), any available defences to such an offence are of equal importance, and often, complexity.
Is there evidence of Duress, or was it Self-Defence etc.
Psychiatric or Psychological reports may be required, a second post-mortem examination to establish the cause or time of death may be needed.
